9. Risk of Loss
Stor-Mor bears the risk of loss or damage to a building until delivery has been completed. Upon delivery, all risk transfers to the customer. You are responsible for inspecting the building prior to accepting delivery. If a return is initiated, you assume risk of loss until the building has been retrieved.
10. Not Intended for Human Occupancy
Stor-Mor buildings are not designed or intended for human habitation and may not comply with residential building codes. You acknowledge that any modification for occupancy is done at your own risk.
11. Warranties
Stor-Mor provides or assigns the following warranties:
• 5-year workmanship warranty
• 10-year flooring warranty (assigned)
• 5/50-year wood siding warranty (assigned)
• 40-year metal roof warranty (assigned)
These warranties do not cover damage resulting from natural disasters (including floods, fires, lightning), accidents, misuse, improper maintenance, or corrosive environments. Any alterations to the building may void applicable warranties.
All repossessed or used buildings are sold as-is, with no warranties provided.
To the fullest extent permitted by law, Stor-Mor disclaims all other warranties, including implied warranties of merchantability and fitness for a particular purpose.
12. Delivery Terms
Delivery dates are estimates only and are not guaranteed. Stor-Mor is not responsible for delays or any costs incurred due to delayed delivery.
You must provide clear and unobstructed access to your property for delivery. This includes ensuring that the delivery path is free of obstacles and underground hazards such as utilities, sprinkler systems, or septic systems.
Due to the size and weight of delivery equipment, property damage may occur if conditions are not suitable. You assume responsibility for any such damage unless caused by intentional misconduct.
Additional charges may apply if a second delivery attempt is required.
13. Permits and Compliance
You are responsible for obtaining any necessary permits and ensuring compliance with local, county, state, and HOA regulations prior to purchase or delivery.
14. Remedies and Dispute Resolution
All sales are final except as provided under applicable warranties or return policies.
You agree not to initiate chargebacks or payment disputes without first attempting to resolve the matter directly with Stor-Mor.
Any unresolved disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
To the fullest extent permitted by law:
• You waive the right to a trial by jury
• Stor-Mor is not liable for incidental, consequential, or punitive damages
• Total liability shall not exceed the purchase price of the building
15. Privacy
We respect your privacy. We do not sell, rent, or share your personal information, including SMS opt-in data and consent, with third parties for marketing or promotional purposes. Information may be shared with trusted service providers solely to support business operations such as customer service. All other use cases exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Please review our Privacy Policy for full details.
16. Changes to Terms
We reserve the right to update or modify these Terms and Conditions at any time. Updates will be posted on this page with a revised effective date.
17. Governing Law
These Terms and Conditions, and any dispute arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State in which Stor-Mor Portable Buildings operates, without regard to conflict of law principles. Any disputes shall be resolved in accordance with the Arbitration section of these Terms.
